Marking
You may have seen a notice marked on some manufactured goods such as "U.S. Patent 5,567,890" or the like. The Canadian Patent Act does not require any marking of goods with notice of a patent pertaining to those goods; nor does it prohibit such marking. A patent applicant may mark articles embodying the invention with the words "Patent Applied For", or "Patent Pending" if in the country or countries in which such articles are marketed, a patent application has been filed. Such marking generates no legal rights. The words usually are intended to serve as a warning to competitors that a patent may issue on the invention at any time.
