Litigation

Not all Canadian intellectual property firms have an active litigation practice supported by extensive trial and appellate experience.  Ours does.

Our senior partner, Robert H. Barrigar, Q.C., is acknowledged to be among the leading intellectual property counsel in Canada.  From time to time Bob has received accolades from counsel rating services and others such as "the most recommended intellectual property counsel in Vancouver".  He has been trying intellectual property cases since his most junior years at the bar.

Bob's practice has included acting as counsel in major intellectual property litigation for a number of multinational companies, including Bristol-Myers, Kraft General Foods, Whirlpool, General Mills, Caterpillar, Alcan, Dennison Manufacturing, CIBA-Geigy, RCA, IBM, Beecham, and Kimberly-Clark, among others (the reader will note that the names of some of these companies have changed over the years as a result of mergers and acquisitions).

But Bob and others in our firm have more frequently represented clients of more modest size, and are thoroughly aware of the need to make litigation as cost-effective as possible. Intellectual property litigation, and especially patent litigation, is often very expensive; a careful review of the client's competitive strategy and how litigation may serve that strategy should be made before commencing litigation and updated from time to time as a lawsuit progresses.

That Bob is the author of an acclaimed current book on Canadian patent law, has acted as special counsel to the Government of Canada on trademark matters, and has personally served as lead counsel in cases in all principal branches of intellectual property litigation, contribute to the depth of his experience and expertise.  Bob was paid the ultimate compliment by being asked by the American Intellectual Property Association to participate in the drafting of an
amicus curiae brief in a software patent case before the Supreme Court of the United States.

Bob is supported by our firm's capable litigation team, who bring useful courtroom experience as well as preparatory, drafting and counselling experience to bear on clients' lawsuits.
