Who Qualifies as a "Public Authority"?

Organizations, including some non-profit corporations and incorporated or unincorporated associations, may qualify as a public authority if they satisfy the following criteria:

  1. They are under some degree of government control, some of which may be inferred from the manner of their constitution, incorporation, etc. or in their charter or by-laws, and other of which may from time to time occur through compliance with government directives, policies, etc. and
  2. In the event of their wind-up or dissolution, their assets are used for a public purpose.
  3. Their on-going activities serve a public or quasi-public purpose, or a charitable purpose.They are funded at least in part by a government or government agency.
  4. They have reasonably active on-going communication with representatives of government or of a government agency.
