(D)
Please include full name and post office address of
the applicant. If the applicant is a
corporation, please state the jurisdiction of incorporation.
(E)
Please note that the U.S. "small entity"
definition does not apply in Canada. A
"small entity" for Canadian purposes is either a university or is an
entity employing 50 or fewer employees.
A small entity must not have transferred nor licensed the rights in the
patent application (nor be obliged to do so) to an entity not qualifying as a
small entity.
(F)
The applicant must file a request for substantive
examination and pay the official examination fees within five years of the
Canadian filing date. Please advise
whether we should request examination when we file the application, or defer
filing such request for now.
(G)
Please provide full name(s) and address(es) of the
inventor(s).
(H)
Please provide the title of the invention.
(I)
Please fill in the country, application serial number
and filing date of every priority application.
If only partial priority applies in respect of any prior application,
please provide particulars.
(J)
Please provide the international application number,
international filing date and whether the application is proceeding via Chapter
I or II of the PCT.
(K)
Please check off which documents you are including
with the form.
(L)
Please provide any additional instructions you may
have for filing purposes.
Please note the following:
1) A certified copy of a priority document is not
ordinarily required.
2) Barrigar Intellectual Property Law can sign the
Petition and obtain a filing date without a signed appointment of agent.
3) Unless the application is the national phase entry
of a PCT application, a complete filing must include an abstract, disclosure,
claims, and any necessary drawings. If
the application is a PCT national phase entry, all we need is the cover sheet
of the published PCT application, or of the particulars on that sheet,
excluding the abstract. Note that we
can prepare the Petition or National Phase Entry form. An assignment, if needed, can be filed
later. Informal drawings may be filed
originally, but must be replaced by formal drawings during prosecution. Retyping, if necessary, can frequently be
deferred until allowance.
If you have any questions with respect to the patent
instruction form, or if you wish to have a schedule of our fees mailed to you,
please contact one of the Barrigar Intellectual Property Law offices listed
above. When the form has been
completed, please fax or mail the patent instructions together with any
accompanying materials to an office designated above.
When the form has been completed, please fax, e-mail
or mail the trademark instructions together with any accompanying materials to
a Barrigar Intellectual Property Law office designated above. Please note that e-mail despatch is not
secure; we can advise as to choice of encryption techniques upon request.
