Trademarks

  • Trademarks are among the most important assets of a business. They deserve protection.
  • Trademarks are territorial. Use and registration in one country create no rights in another country.
  • Any important trademark should be registered in every country in which goods associated with the mark will be sold. Most trademark registrations last 15 years and can be renewed.
  • For a word trademark, it usually costs at least about $2,000, to prepare and file an application in Canada. Add at least $600 if a registrability search is to be done. Preliminary advice often adds at least about $500 or more to our fees. A U.S. filing costs at least about $3,000 for one class of goods or services, more if other classes are to be covered.
  • Prosecution costs incurred over about two years add appreciably to the overall expense. Count on spending at least about another $2,000 before your registration is granted.
  • Consider registering internet domain names that include your more important trademarks.
